TinniMix Terms of Use

These terms are an agreement between you and Masterclass Multimedia LLC ("we", "us") about your use of the TinniMix app for iPhone, Apple Watch and Android, and its community ("TinniMix"). By using TinniMix you agree to them. If you don't agree, please don't use the app.

The short version

• TinniMix is a wellness and sound app. It is not medical care, and nothing in it is medical advice.
• You're responsible for your own listening volume and for seeing a doctor about your health.
• Be kind in the community, and don't post medical advice, cures or personal details.
• The app is provided as it is, without guarantees, and our liability is limited.

1. Who can use TinniMix

You must be 18 or older, or have a parent's or guardian's permission. You must be 13 or older to join the community. TinniMix is not meant for children under 13.

2. Not medical care or advice

TinniMix is a general wellness and relaxation app. It is not a medical device. It does not diagnose, treat, cure or prevent tinnitus, hearing loss or any other condition.

TinniMix's creator is not a doctor, audiologist or other licensed health professional. Everything in the app, including articles, lessons, exercises, sounds, the tinnitus Finder, the hearing and headphone checks, the safety check and community posts, is general information only. It is not a substitute for professional advice, diagnosis or treatment. Using TinniMix does not create a doctor–patient or any other professional relationship.

Always talk to a doctor or audiologist about your tinnitus, your hearing and your health. Never ignore professional advice, or delay getting it, because of something in TinniMix.

The hearing and headphone checks are not medical hearing tests. The safety check lists warning signs worth a doctor's attention; it cannot rule anything out.

3. Your hearing and your safety

Loud sound can damage hearing. TinniMix limits its own output and estimates safe listening time, but it cannot measure how loud your headphones, speakers or device actually are. You are responsible for your listening volume and how long you listen. Keep every sound quiet and comfortable, and stop right away if a sound hurts, your tinnitus gets worse or anything feels wrong.

The breathing, relaxation, movement and thinking exercises are for general wellbeing. Stop any exercise that causes pain, dizziness or distress. If you have a medical or mental health condition, check with your doctor first.

Don't use TinniMix where you need to hear what's around you or stay alert, such as when driving, cycling or operating machinery.

4. Not an emergency service

TinniMix is not a crisis or emergency service, and nobody monitors it for emergencies. If you are in crisis, thinking about harming yourself, or need urgent help, call your local emergency number or a crisis line right away. The support lines listed in the app are run by other organisations; we don't control them and can't guarantee they're available.

5. Your licence to use the app

We give you a personal, non-transferable licence to use TinniMix on devices you own or control, for your own non-commercial use. You may not copy, resell, reverse engineer or interfere with the app or its community, or use them unlawfully.

TinniMix, its sounds, text, design and code belong to Masterclass Multimedia LLC or its licensors.

6. The community

The community is optional. If you join:

• Your account. You're responsible for what happens under your account. Choose a username that isn't your real name and doesn't impersonate anyone.
• Community rules. Be supportive. Don't post medical advice, cure claims, advertising, links, contact details, anything that identifies you or someone else, or anything unlawful, hateful, harassing or sexual. The full rules are shown in the app.
• Your posts. You keep ownership of what you post. You give us a worldwide, free licence to store, show, translate and share it within TinniMix, including showing messages of encouragement to other people using the app. That licence ends when you delete the post or your account, except for copies other members have already saved (for example a shared preset).
• Other people's posts. Posts come from other users, not professionals, and don't reflect our views. One person's experience is not medical advice. Don't rely on a post in place of a professional.
• Moderation. We may review, hold, edit or remove posts, give strikes, and suspend or close accounts that break these terms or the rules. We aren't obliged to monitor the community and aren't responsible for what members post.
• Reporting. You can report any post in the app. To report content that infringes your copyright, email support@tinnimix.com with the details.
• Leaving. You can delete your account and everything you posted from inside the app at any time.

7. Clinicians

If you share presets as a clinician, you confirm that you hold the licence you say you hold and that you are responsible for your own professional advice to your patients. TinniMix only passes on the sound settings you choose.

8. Tips

TinniMix is free. Tips are optional in-app purchases handled by Apple or Google under their terms. A tip doesn't unlock anything or create any entitlement, and tips are non-refundable except where the law or the store's policy says otherwise.

10. Other companies' services

TinniMix relies on services from other companies, such as Apple, Google and Google Firebase, and links to outside websites and studies. Those are governed by their own terms, and we aren't responsible for them.

11. No guarantees

TinniMix is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We don't promise that TinniMix will ease your tinnitus, help you sleep or improve your health, that it will always be available or free of errors, or that its information is complete or current.

12. Limits on our liability

To the fullest extent the law allows, Masterclass Multimedia LLC, TinniMix's creator and anyone working with them are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of hearing, health, data or income, arising from your use of TinniMix, however caused. Our total liability for any claim about TinniMix is limited to the greater of the amount you paid us in the past 12 months and US $50.

Some places don't allow some of these limits, so parts of sections 11 and 12 may not apply to you. Nothing in these terms limits liability that can't be limited by law.

13. If someone makes a claim because of what you did

If someone brings a claim against us because of something you posted or because you broke these terms, you agree to cover our reasonable costs and losses from that claim, to the extent the law allows.

14. Ending and changing

You can stop using TinniMix at any time. We may suspend or end your access to the community if you break these terms. We may change or stop offering TinniMix or any part of it.

We may update these terms. If a change is important, we'll tell you in the app and ask you to agree again. The date at the top shows when they last changed.

15. Law and disputes

These terms are governed by the laws of the State of Colorado, without regard to its conflict-of-law rules. Any dispute about TinniMix or these terms will be decided by the state or federal courts located in Colorado. If you're a consumer, you also keep any rights your local law gives you that can't be waived.

If part of these terms can't be enforced, the rest still applies.

16. Apple and Google

These terms are between you and Masterclass Multimedia LLC, not Apple or Google. For the iPhone and Apple Watch apps:

• Apple is not responsible for TinniMix or its content, and has no obligation to provide maintenance or support for it.
• If TinniMix fails to meet a warranty that applies by law, you can notify Apple, and Apple will refund the purchase price (if any). Apple has no other warranty obligation.
• Apple is not responsible for claims about TinniMix, including product liability, legal or regulatory compliance, consumer protection or intellectual property claims.
• You confirm you aren't in a country under a US government embargo and aren't on a US government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and can enforce them against you.
